Our Commitment to Your Privacy: The Center for NeuroWellness (CNW) is committed to protecting the privacy of your medical information. We are required by law—including the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the Health Information Technology for Economic and Clinical Health (HITECH) Act of 2009, and the HIPAA Omnibus Rule of 2013—to maintain the confidentiality of your protected health information (PHI), provide you with this Notice of Privacy Practices, and abide by the terms of this notice.
How We May Use and Disclose Your Medical Information: We may use and disclose your medical information for the following primary purposes without your separate written authorization:

Special Protections for Psychotherapy Notes: Psychotherapy notes (notes recorded by your provider documenting counseling session contents) receive higher protection under HIPAA. Use or disclosure generally requires your separate written authorization, beyond what is described in this notice. Contact your provider with questions.
Special Protections Under New Jersey Law for Mental Health Services: CNW employs licensed psychologists, Licensed Professional Counselors (LPCs), and Licensed Clinical Social Workers (LCSWs), all of whom provide confidential mental health services.
Under New Jersey law, confidential communications between patients and these licensed mental health service providers during the course of treatment for mental or emotional health conditions are protected under the unified Mental Health Service Provider-Patient Privilege (New Jersey Rule of Evidence 534). This privilege applies to communications with:

These protections are generally stronger than federal HIPAA requirements in many cases and promote trust in therapy. LPCs and LCSWs have additional confidentiality safeguards under their licensing statutes (N.J.S.A. 45:8B-49 for counselors; N.J.S.A. 45:15BB-13 for social workers). We obtain your signed and dated acknowledgment of this notice and informed consent for telehealth. All telehealth complies with HIPAA, New Jersey Board of Psychological Examiners rules (N.J. Admin. Code § 13:42 Subchapter 13), and applicable privacy standards.
Substance Use Information: CNW is not a federally assisted substance use disorder treatment program under 42 CFR Part 2 (“Part 2”). However, substance use issues, when present, are addressed as secondary to primary psychological treatment.
If we create, receive, maintain, or transmit records protected under 42 CFR Part 2 (substance use disorder patient records), these records receive additional federal protections beyond standard HIPAA rules. We will only use or disclose such records as permitted under Part 2, which generally requires your written consent for most disclosures (with limited exceptions, such as certain treatment, payment, and health care operations uses under a single consent where allowed).
These records generally cannot be used or disclosed in civil, criminal, administrative, or legislative proceedings against you without your written consent or a court order (after you receive notice and an opportunity to be heard). Redisclosure of Part 2 records by recipients is also restricted unless permitted by law or your consent.
We apply the highest level of protection required by law to any such records. If you have questions about Part 2 protections or how they apply to your information, contact us.
